Covid, from the squeeze on workers without a pass to free tampons at school: this is what the new DL provides

“In order to protect public health and maintain adequate safety conditions in the provision of care and assistance services, the vaccination obligation for the prevention of Sars-CoV-2 infection applies to Italian citizens and other States EU members residing in the territory of the State, as well as foreign citizens who have reached the age of 50 “. It is with these words that the draft of the latest decree prepared by the Government (six articles in all) introduces, to thearticle 1, the vaccination obligation for all over 50. The obligation is in force until June 15, 2022.

Exemption or deferral of the obligation only in special cases

The Decree being examined by the Council of Ministers provides for the exemption (or deferral) from the obligation “in the event of an ascertained danger to health, in relation to specific documented clinical conditions, certified by the general practitioner or by the vaccinator, in compliance with the circulars of the Ministry of Health regarding the exemption from vaccination against Sars-CoV-2. For those who are immunized for having contracted the disease, the obligation is only postponed: according to the text “the successful immunization following a natural disease, proven by the notification made by the attending physician – determines the postponement of the vaccination”.

From 15 February over 50 to work only with Super pass

Article 1 also provides for an extension of the use of vaccination and recovery certificates in the workplace. In practice, starting from February 15, 2022, public and private workers, including judicial workers and magistrates, who have turned 50, to go to work will have to show the Super Green pass, which is obtained with the vaccine or with healing from Covid.

Over 50s without Super pass no salary but remains seated

Workers over 50 who present themselves at the workplace without having a Super Green pass will be considered “unjustified absentees, without disciplinary consequences and with the right to retain the employment relationship, until the presentation” of the green certificate. Access to workplaces without a certificate attesting vaccine or recovery is “forbidden” and those who do not respect the prohibition will suffer an administrative sanction between 600 and 1,500 euros.

The incoming draft of the Legislative Decree being examined by the Council of Ministers regulates,article 2, the extension of the use of vaccination and recovery certificates. In summary, until March 31, 2022 it will be necessary to have the Super Green pass to access “personal services” such as the hairdresser but also for “public offices, postal, banking and financial services, commercial activities, except for those necessary to ensure the satisfaction of essential and primary needs of the person “.
