The Berlin administrative court has overturned the alcohol ban in the district in James Simon and Monbijou Park for the time being.

In July, the district office had imposed the alcohol ban with reference to the repeated parties, the noise pollution and the littering of the park. In August, the working group of critical lawyers at the Humboldt University, together with a lawyer, filed an objection to the decision and applied to the administrative court for the suspensive effect of the objection in an urgent application.

The administrative court granted the application in a decision on Thursday. The Chamber found that the order to ban alcohol was unlawful as a whole. The district office already lacks the legal basis to enforce a ban on alcohol in the parks.
