Bullying, sexual harassment, discrimination, aggression and violence by colleagues or managers. It is undesirable behavior that still occurs too often in the workplace and also has a major impact on people. It is unacceptable and must be prevented. With the introduction of a mandatory code of conduct for undesirable behavior, the government wants to build on a socially safe working environment for every employee. State Secretary Nobel (Participation and Integration) has opened the bill for internet consultation.

The preparation of a code of conduct is an effective and accessible way for companies to work on a socially safe working environment. It offers employees and employers clarity about what desired and undesirable behavior is. It also takes care of the conversation in the workplace about desired and undesirable behavior.

National Action Program

At the beginning of 2023, sexual cross -border behavior and sexual violence were announced in the National Action Program Approach to Sexual Violence, including obliging a code of conduct. The bill that now goes into internet consultation sets a number of codes of conduct. For example, that employers must provide information to employees about the code of conduct. At the same time there is room for customization. This means that employers themselves, within the set frameworks, can determine the content of the code of conduct and the process around it.

Employers are already obliged to implement policies to prevent psychosocial labor tax. The introduction of the compulsory code of conduct partly gives substance to this.

The bill makes an exception for small employers with fewer than ten employees.
