Minister of Housing and Spatial Planning Minister Mona Keijzer is starting the internet consultation today for an amendment to the law that must make hospita rental more attractive. There will be a special lease contract of a maximum of five years, a shorter cancellation period of one month in the first month and it becomes easier to terminate hospita rental in the event of sale or death. For tenants, the annual income -related higher rent increase can expire or reduce if it was the result of hospita rental. Interested parties can use the Internet consultation Respond to the proposed changes up to and including 26 August 2025.
The changes must ensure that more people can rent a room in the house where they also live themselves. The proposal thus contributes to the better use of existing buildings. In addition to new construction, Hospita rental is a way to help more people with living space.
Special HospitaHuur Contract
Especially for Hospita rental there will be a lease contract of a maximum of five years with a trial period of nine months. This new lease contract replaces the scheme that has been around since the 90s and makes renting possible for a maximum of one year, with a cancellation period of three months. After this year, the tenant automatically has a fixed lease. Research shows that Hospita’s tenants would like to offer accommodation for more than a year. In practice, they often do not dare to do this without the possibility of being able to cancel the rent in the interim. It also appears that tenants would like to rent a room for more than a year, but often not much longer than a few years.
Short cancellation period
In the first month of the hospithaure contract, the contract can be terminated with a cancellation period of one month. After that first month, the standard notice period of three months applies again.
Termination of the lease contract easier
Some of the mortgage providers currently do not give permission for hospita rental, because a home yields less when a tenant lives in it. In order to cross mortgage lenders to allow Hospitaverhuur more often, owner-residents may terminate the hospitality contract after the change in the law in the event of a (forced) sale of the home or at the death of the Hospita. This also applies to lease contracts of independent homes that are on the same cadastral plot and the same address as the home of the owner-resident.
Income -dependent higher rent increase
Tenants who are Hospita can request their landlord after the amendment to not implement an income -related higher rent increase. The income of the Hospitahuurder no longer counts in determining this higher rent increase. This makes hospita rental financially more attractive.
