The government replaces the nitrogen goals in the Environment Act by emission goals that are laid down in a legally required program. The measures are also included in that program to achieve those goals. In this way, the government shifts the focus of steering on nitrogen battle to steering on nitrogen emissions, and the government opts for stable goals. Goals are included in the Environment Act for reducing the nitrogen battle. These goals are based on the critical deposition value (KDW). The KDW is the scientifically determined limit above which nitrogen battle can be harmful to nature. That limit is different per type of nature.
The cabinet wants to get rid of the KDW as an environmental value in the law because it is a ‘too mobile’ goal. The task resulting from these goals has increased considerably in recent years. The government emphasizes that it is impossible to pursue consistent and long -term policy if the size of the statement changes in the interim. The current goals are no longer considered feasible by the government, partly because of the social, social, financial and economic consequences of the nitrogen measures. By shifting the focus from precipitation to emissions, there is more grip on the assignment.
A legally sustainable alternative
The government program includes the agreement to remove the KDW goals from the law and to replace it with a legally sustainable alternative. The government is choosing as an alternative emission objectives, which are included in a legally required program. The legal program will also contain measures to meet those goals. A program ensures that measures are well coordinated and that adjustments are made if necessary.
The current legal goals also have a corresponding program, namely the program of Nitrogen Reduction and Nature Improvement (PSN). The legal program will be a supplement and update of the current PSN and will contain the measures to which the MCEN has decided to get the Netherlands back from the nitrogen lock. The European agreements are also taken into account.
Follow -up process
The internet consultation runs from 14 July 2025 to 24 August 2025. After processing the reactions from the internet consultation, the bill, via a decision in the Council of Ministers, will be sent as soon as possible for advice to the Advisory Department of the Council of State. It is expected that the bill will be sent to the Lower House for treatment at the end of 2025. As soon as the Second and First Chamber have agreed and the law has been published, the new law is in force.
Parallel to the internet consultation, the legally mandatory program is further elaborated, so that future decision -making of the MCEN can also be included.
