According to media reports, the Berlin Senate Administration has warned the Berlin Constitutional Court against a hasty decision to repeat the September 2021 elections.

In an internal paper, the interior authority first suggested that the state constitutional court go to Karlsruhe, reports the “Berliner Morgenpost” (Sunday), citing a more than 50-page statement.

It must be prevented that there are different constitutional assessments of the election events of September 26, 2021. This would not only result in “irreversible damage to democracy and the rule of law” in Berlin, the newspaper quoted from the statement by the Senate Department. The Berlin “Tagesspiegel” reported about it first.

According to previous plans, the Berlin Constitutional Court will announce its decision on November 16 as to whether the elections to the Berlin House of Representatives and the district assemblies will be repeated. The Bundestag’s Election Review Committee wants to make a recommendation on a possible repetition of the Bundestag elections in a special session on Monday. Parliament is expected to vote on this on Friday (November 11).

In an oral hearing at the end of September, the Berlin Constitutional Court held out the prospect of a complete rerun due to the many glitches in the course of the elections. The state of Berlin then began preparations for a repeat election on February 12, 2023.
