After a request for Cassation was refused today, the extradition by France of a Belgian magistrate to Belgium is final.
Two European arrest warrants had been issued against Luc Monin on 3 February: in Liège he had been sentenced in absentia to five years in prison for fraud and blackmail. He was arrested in France on February 22.
According to the magistrate, it is impossible for him to exercise his defense rights within the Belgian legal system. As a magistrate, he is sentenced directly by the Mumps of Appeal without being able to appeal.
The man resisted extradition. However, a court of appeal in Paris did not listen to this, after which Monin went to the Court of Cassation. However, this did not break the judgment.
In its judgment, the Court of Cassation emphasized that, according to European case law, “the principle of mutual recognition on which the European arrest warrant system is based is based on mutual trust between Member States” in their ability to provide “equivalent and effective protection of the fundamental rights recognized at the Union level”.
