Over the past seven years, the municipality of Aa and Hunze needed two court rules, six welfare advice and two counter-advice to legalize an illegally built roof structure on a semi-detached house on the Annense Kruisakkers (9).
To the great sorrow of the rear neighbors, who have been trying to get rid of the ‘pimple’ on the neighboring home for seven years. Today it was the turn of the Council of State to judge the roof structure.
The use of the conflict is the roof structure that protrudes at the rear and the side of the house. On the side, the structure rests on a pillar that partly hangs above the garage path. The neighbors think it is an ugly pimple and do not understand why the municipality of Aa and Hunze continues to try to legalize the construction built without a building permit.
The first welfare advice was negative. The neighbors also got the same from the lower administrative court. But in 2020 the municipality adjusted the welfare policy and then there was a welfare advice for the sixth time: completely positive this time.
Eventually the Northern Netherlands court agreed with the sixth welfare advice and the latest permit for the structure. The neighbors then went to the highest administrative court in the country, who dealt with the appeal for more than a year and a half after the second ruling due to large crowds and arrears. There the neighbors’ counsel explained that his clients gradually do not understand it so much.
“They were right again and again and every time they thought that the roof structure would go off,” the lawyer explains. “But each time the municipality granted a new permit and she applied for welfare advice for the umpteenth time. They feel that the municipality is squeezing in all sorts of turns to be able to grant a permit.”
A municipal spokesperson for Annen pointed out that there were so many contradictions in the various welfare advice that the municipal administration itself has made a decision. “And it is not unusual that we apply for several welfare advice for a building plan, but six is indeed a lot,” said the councilor of the municipality.
The judge said that he would struggle the last welfare advice again. Because in the last advice, the welfare committee only looked at the roof structure that can be seen from the Cross -makers. And not to the entire structure such as it can be seen from a side street and the rear neighbors.
