Anika has searched for it for a long time and had to muster a lot of patience. She had wanted a place for herself for three years, an apartment of her own. After six years with her ex-students on a small floor, she is more than ready. Her own space, silence when she needs it and always a full fridge.
Recently she bought her ideal apartment in a perfect spot, on the edge of the city and close to the forest. She can already see herself taking a nice walk every day after dinner.

The apartment needs some refurbishment, but Anika is happy to work on that. One of the things she can’t do herself is the parquet floor. It is made of oak, while Anika prefers lighter shades. So she decides to have the floor given a whitewash treatment. In this way the characteristic of the wood remains visible, but it acquires a slight white shine. At least that is the intention.
Disappointed
Anika instructs floor expert Freek by e-mail to carry out the work. When she comes to see the result, she is very disappointed. White wash is applied in a special way with oil to achieve the desired effect; ‘the expert’ simply painted the floor white with semi-transparent paint. Anika thinks the result is a lot less beautiful than she already thought it was.
Anika tries several times to get Freek to remove the paint and to give her floor a real whitewash treatment. If this does not work out, Anika will contact DAS. What are her options now that Freek doesn’t want to do anything anymore?

I get my hands on the matter and decide to write to Freek. He does not comply with the agreement and that means that there is a breach of contract.
I will give him the opportunity to still fulfill the agreement within a reasonable period of time. Freek refuses this and even sends an additional invoice. I then decide to start a procedure to take this to court.
Anika is stiff with nerves. All in all it is a lot of money. What should she do if the judge doesn’t prove her right? I call her regularly and give her the space to share her concerns.
