Ana Obregon shared on Instagram a message from a follower annoyed by the comments towards the presenter after fulfilling “the last will of her son”, compared to Rocio Carrasco, “who has judged a man as an abuser when seven judges found no evidence of a crime and as a mother has exposed her daughter as a criminal.”

Although if someone’s last will was to commit some illegality, it would be understood that it was not appropriate. What is judged is the fact of accessing an illegal surrogate pregnancy that in Spain “seriously violates the fundamental rights of the Constitution and international human rights conventions”, such as the Convention on the Rights of the Child and the United Nations, according to the Supreme Court.

Carrasco did not commit any illegal act. Article 24 of the Constitution recognizes the right to effective protection of judges and courts. The gender violence law is constitutional, although she never denounced it in its specialized courts, but was derived. His case could not be judged because there was never a trial, despite the fact that the judge determined indications. Nor was she found guilty for false denunciation because he was not even sued for it. In her file, she is pointed out for reporting late, despite the Supreme Court’s jurisprudence on it. And although it was interpreted that she could be affected by more events in that period of time, the forensics indicated that there was a “causal relationship between the aggravation of the symptoms and the events reported.” The dismissals in gender violence are common not because they are false complaints but because of the evidentiary difficulties recognized by justice. Even more in cases of psychological violence or vicarious violence, according to the United Nations, which has given several touches to Spain on this issue. That thousands of anonymous women declared the same situation reveals the pattern of justice indicated by the UN, reinforces the condemnation of Spain for institutional violence and shows that Carrasco was not the only one.
