Minister Uitermark (Home Affairs and Kingdom Relations) and Minister Brekelmans (Defence) today announced the amended bill for the Security Investigations Act (Wvo) sent to the House of Representatives. The law has been amended to provide more flexibility to sectors where employees who hold a confidential position frequently change employers.

The most important change is the introduction of a location-based declaration of no objection (vgb). This DPA remains valid in the event of a transfer to a new position at the same designated location. Think of someone who works in the aviation sector and changes employers. In that case, there are fewer administrative burdens and fewer costs for the organizations involved. This means a smoother transition for the employee.

Current insight into confidential positions

With the amendment to the Wvo, a register will be created that provides insight into people who: a confidential position clothe. Employers are obliged to report to the Security Investigations Unit of the AIVD and MIVD (UVO) when someone is going to fulfill a confidential position and when that person no longer performs the position in question. The UVO thus has an up-to-date overview of all active confidential officers.

Finally, the opportunity is taken to include some changes that improve the feasibility and enforceability of the Wvo in practice.
