A woman who worked at the Elisabeth-TweeSteden Hospital in Tilburg for 30 years and was put aside by the hospital because of bullying behavior must be hired by the hospital again. The court in Breda determined this on Wednesday.
The woman worked on the ENT clinic (throat, nose and earnostics). According to the hospital, an ‘untenable and unworkable situation’ had arisen on the outpatient clinic. The hospital is said to have received several reports from employees that the woman showed bullying behavior.
The hospital then presented the woman two options: following an improvement process in another department or the termination of the employment contract. The woman did not go along with that and demanded in summary proceedings that she was simply admitted to her work on the ENT clinic. The judge in favor of her on Wednesday.
According to the judge, there is ‘insufficient reason’ not to let her go to work on the ENT clinic. The return of the woman will “require the necessary preparation and flexibility from both parties,” the court concludes.
