The umbrella organization of fan aid has made demands on politics for the Bundestag election – it is about old and new areas of tension between fans and the police and the judiciary.

During a media appointment, the umbrella organization, in which 27 fan aids from fan scenes from clubs from Germany are organized, released its demands on the parties on the occasion of the Bundestag election on February 23. Right to refuse to testify? “Legislative gap, must be closed”

A claim refers to a right to refuse to testify in the social work that has not yet existed. This meant that employees of the social pedagogical fan project in Karlsruhe were sentenced to fines. For example, while lawyers, doctors, pastors or journalists have a right to refuse to testify, there is no such for social work. For the fan projects, however, the confidentiality of their conversations is crucial in order to have and keep access to the fans. “This is a legislative gap that urgently needs to be closed,” said Oliver Wiebe from Fanhilfe Magdeburg. Wiebe is a spokesman for the umbrella organization. “The fan projects are dependent on a good relationship with their target group. We need a change in the Code of Criminal Procedure here.”

Labeling required for federal police

The umbrella organization also requires a labeling obligation for the federal police. This is the only way to be an individual law enforcement of civil servants if they apply illegal or disproportionate violence. “There are no ways for fans to report obvious police incorrect behavior”criticized Linda Röttig from the umbrella organization of fan aids. For example, the federal police secure train stations, in the environment of which there can be conflicts with fan groups.

Opponents of a labeling obligation criticize an unauthorized general suspicion against the police. Supporters, on the other hand, see this cleared out because the labeling can be used to individually examine a possible misconduct. In its coalition agreement, the previous government of the SPD, the Greens and the FDP had notified an anonymous labeling of the federal police officers, so far the project has not been implemented.

There are different regulations at the country level. While a labeling obligation applies, for example in Hesse, Thuringia, Rhineland-Palatinate or Brandenburg, there is no such regulation in countries such as Bavaria, Baden-Württemberg or Saxony. The procedure is also different in Europe: while Denmark, Belgium, Spain or Greece have a labeling obligation, they do not exist in the Netherlands, Austria or Italy.

At the same time, according to the will of the fan aids of the federal police officer, in his role should be strengthened in order to ensure a complaint office. Here, too, opponents see an unjustified distrust of the federal police’s work, with this reasoning, for example, the CDU decided to abolish the position as the goal in a position paper for the federal election.

Old dispute file file violent offenders still there

Again, the fan aids demand a replacement of the so -called file violent offender sport. The police see this a useful instrument to “Take police measures in a targeted manner and to distinguish between interference and non -interrogators”. However, the file has been the subject of discussions since its introduction in 1994, since it does not need a legitimate conviction to be recorded in it. An initial suspicion is sufficient for an entry, the people recorded do not have to be informed. “The file is stigmatizing, non -transparent and arbitrary”said fan aid spokeswoman Röttig.

The traffic light government had promised a reform, but had not implemented it. In October, the Federal Constitutional Court ruled that parts of the Federal Criminal Police Act are unconstitutional, including storage practice. The verdict already moves in the topic, the Federal Constitutional Court set a period until July 31, 2025.

Further demands provide for the so-called “chat control” at the EU level and an extended monitoring of telecommunications in Germany. The fan aids criticize a disproportionate interference with privacy. Also the paragraph in criminal law, which is newly introduced in 2017, which provides for tougher punishments in assault on enforcement officers than in general criminal law. Criminal prosecution is already possible with these regulations.

Reference to the police figures: “Stadium visit is safe”

There was no separate problem with fan violence, was called the umbrella organization of fan aids. “Hundreds of thousands of stadium visitors clearly show week after week that nobody has to be afraid of entering a football stadium.” This would also prove that the police’s figures. However, according to ZIS, the annual report 2023/24 has negative trends – with increasing numbers of injured people and initiated criminal proceedings. “The security situation did not relax compared to the previous season, but worsened”police director Oliver Strudthoff, head of the ZIS, is quoted in a message. The numbers of the injured (13.8 percent) and the criminal proceedings (12.4 percent) initiated rose more than the number of fans in the stadiums (6.6 percent) compared to 2022/23.
