The government is taking measures to effectively tackle the growing threat of explosions. The explosions are often caused by extremely dangerous F4 fireworks that are prohibited for private individuals and are only intended for professional use. The increase in the number of explosions has a major impact on safety in residential areas and contributes to feelings of insecurity. These explosions are not only related to criminal conflicts, but also to conflicts in the relational sphere.

“No fireworks, but hand grenades”

Minister of Justice and Security, David van Weel, expresses serious concerns about the increasing number of explosions. “What we see here are no longer fireworks incidents, the power of these explosives is comparable to that of hand grenades. These explosives are often placed at people’s doors, which greatly increases the risk for residents and local residents. This is a different kind phenomenon than fireworks, and we must approach it differently.”

Van Weel emphasizes that this is not a solution in the form of a national fireworks ban, as explosions of this type occur all year round. “Every night there is a hit somewhere in the Netherlands. This problem is broader and requires specific measures aimed at discouraging both the demand for and the supply of illegal explosive material.”

Weapons and Ammunition and EU Cooperation Act

As part of the approach, the government is drawing up a joint guide with the Public Prosecution Service and the police. This guidance makes it clear that F4 fireworks, if found in the hands of people without a specialized permit, can be qualified as a weapon under the Weapons and Ammunition Act and which powers apply to this. In certain circumstances, this offers enforcement options such as preventive searches and higher penalties, which can reach up to 8 years in prison.

At European level, the Netherlands is working with France to combat the international illegal trade in fireworks. This should ensure stricter legislation and more cooperation to make the supply of illegal fireworks to the Netherlands more difficult.

Maintain existing enforcement resources

The government emphasizes that it is important to maintain the existing enforcement options through the Economic Offenses Act. This law provides an effective instrument for early detection of illegal fireworks and explosives. The government continues to focus on an integrated approach by using both the Economic Offenses Act and the Weapons and Ammunition Act.
