S.’s daughter celebrated her birthday on April 21, 2024. After the party he assaulted the victim twice during the night; first on the couch in the living room, where he cupped her buttocks and the side of her breasts.
Later, when the victim was in bed with S.’s daughter, he assaulted her again. There he put his hand under the blanket, where he touched her, among other things, on her buttocks, legs and over her clothing in her crotch.
Emotional call to mother
The court finds the victim’s statements reliable because they are consistent, complete and detailed. In addition, there is enough supporting evidence, according to the court, which means that it finds sexual assault proven.
For example, the victim allegedly called her mother very emotionally the next day to say that her friend’s father had groped her. The mother then saw that her daughter’s behavior changed.
S. then also said that he was in the bedroom and that he touched the victim’s underpants, buttocks and lower leg. His own daughter confirms that her father was in the bedroom. DNA from the 51-year-old man was also found on the edge of the victim’s underpants.
Still psychological consequences
The court blames the man for touching the young woman in a vulnerable position. She had been drinking and was half asleep at her friend’s house.
“The suspect has thus abused the vulnerable position of the victim. The victim statement read on behalf of the complainant shows that she is still experiencing the psychological consequences of the suspect’s actions.”
