Creditors have so far jointly claimed more than 2.4 million euros from the bankrupt company B&B Afvalrecycling in Nieuw-Dordrecht. This is evident from the initial investigations by the appointed curator.
The waste processor was declared bankrupt at the beginning of last month. Large mountains of waste remain on the site, for which no solution has yet been found.
Curator Paul van Boven has published his first findings, but the research is still in full swing. The Tax Authorities say they are still owed more than 870,000 euros from B&B Afvalrecycling. In addition, there are so far 37 other creditors who together claim more than 1.5 million euros.
The curator still cannot say much about the cause of the bankruptcy. “There have been large withdrawals from the company’s bank account. They played a major role in the demise of the company. But I cannot say who withdrew that money,” said Paul van Boven.
However, he states in his first report that there is a suspicion of improper management. For example, the last annual accounts are for 2021 and the accounting obligation has probably not been met.
Furthermore, the current owner of the company made a remarkable statement. Until December 1, 2022, he ran the company with two other directors. But they deregistered. The only remaining owner states that until recently he was not aware of the fact that the other directors have stopped.
In the meantime, the curator focuses mainly on the so-called legality investigation and further inventory of the debts. He also does not have a solution for the remaining waste mountains on the site in Nieuw-Dordrecht. “There is no money, so as a curator I have no options to offer solutions. The municipality’s environmental department is involved. But the waste mountains are still there.”
The municipality of Emmen has announced that the mountains of waste on the site constitute a violation. “The usual enforcement procedure has been initiated and is ongoing; this means that we are trying to persuade the landowner to end the violation. We are in discussions with the owner and he has now presented us with an action plan.”
The Drenthe Environment Agency and municipal enforcement supervise this. According to the municipality of Emmen, there is now some drainage at the location. At this time there is no financial damage that should be recovered, the spokesperson says.
