Claims for damages amounting to millions, alleged insults against Volkswagen and the question of legal dismissals: a legal dispute between the car manufacturer and two managers continues to concern labor courts in Lower Saxony.
The Braunschweig Labor Court announced that because a Volkswagen manager passed on internal information to the State Criminal Police Office (LKA), among others, the ordinary termination was effective.
According to VW, the reason for the termination was the accusation that internal audit reports on the Crafter and Grand California models were passed on to the media and public bodies without authorization. From the company’s perspective, this was impermissible and represented a massive breach of duty.
Court sees serious breach of duty by VW manager
The judge described the transfer to the State Criminal Police Office as inadmissible because the LKA is not an external reporting agency within the meaning of the Whistleblower Protection Act. From the court’s point of view, this was a serious breach of the duty to show consideration for the company. However, the court declared the extraordinary termination against the man to be ineffective because VW had missed the two-week deadline.
Volkswagen sees its legal opinion confirmed that the plaintiff’s misconduct was breach of trust and relevant to termination, said a company spokesman.
Judge wants to collect evidence in the second case
In the case of the second manager, the court wants to collect evidence. This is intended to clarify the facts on which the termination was based. The two managers worked at VW in a department that was founded after the diesel scandal in 2015 to uncover grievances.
In another case, the two plaintiffs from the senior management group are demanding millions in damages from VW. In this case, the Braunschweig Labor Court dismissed the lawsuits. The appeal is scheduled to be heard on April 24th at the State Labor Court in Hanover.
