“The right to strike is not a favor from the employer, but a fundamental right.” The railway unions ACV-Transcom and ACOD Spoor are bewildered now that the Council of State has rejected their request in urgent proceedings. As a result of this ruling, the refusal of their strike notice for February 5, 10 and 12 remains in force, meaning that rail employees who nevertheless take action risk disciplinary sanctions.
