But the court does not agree with that. According to the court, K. could have left the house earlier, after they were separated following an argument. “The suspect did not choose to do so, but continued to fight with the victim,” the court said.

Talk about disorders

Research shows that K. has several psychological disorders. “After using alcohol or drugs, the suspect can seriously overstep the mark,” the court said. According to the court, this is also evident from the previous convictions on his criminal record. Even when he was previously in custody, things are said to have gone wrong more than once.

“Previously provided assistance could not positively change the suspect’s behavior and during the hearing he showed no self-insight and was not open to assistance.” That is why, in addition to a prison sentence, TBS with compulsory treatment is imposed.

In its judgment, the court does take K’s psychological disorders into account. These would make him less accountable. K. must pay compensation to the victim’s minor daughter, his mother and to an aunt of Marvin, who was his foster mother for a long time.

The prison sentence is imposed three years lower than the court’s ruling last year. Justice wanted K. to go to jail for nine years.
