The Public Prosecution Service has demanded a prison sentence of 8 years and TBS with compulsory treatment against a 26-year-old man from Uithuizen for, among other things, fornication and two rapes in Assen and Groningen. He denies almost all facts.
According to the Public Prosecution Service, the man raped a 17-year-old girl on August 18, 2023. On a cycle path, the man is said to have suddenly jumped out of the bushes and pulled her off the bike. According to the victim, he tried to grab her phone and knocked her down with a punch. She tried to run, but the man allegedly caught up with her and then choked her throat. He then forced her into a car and forced her to perform sexual acts. In addition to raping this victim, he is also accused of deprivation of liberty.
The victim said in her victim statement that she no longer lived carefree since the incident. “Every car that drives by makes my heart beat faster with fear. Any man could be him.” What happened to her was what every young woman fears, said the prosecutor, who considered the victim’s statement reliable and credible. According to her, the suspect acted systematically and waited for her and chased her like a predator.
The man is also accused of rape in Assen on July 19. This would have happened after a first date. He allegedly took the victim from Groningen to a remote parking lot near Assen, where he raped her. The man also denies this fact. According to him, it would have happened by mutual consent.
Child pornography found on the man’s data carriers subsequently led to the allegations of indecent exposure. This allegedly involved three minor victims and an attempted sexual assault on the part of a fourth victim. The man allegedly gave sexual assignments online to the girls, who were 11, 9 and 6 years old at the time. The fourth victim is from Australia and her age is estimated between 8 and 12 years. The suspect stated that he could not see that the girls were minors.
The man did not want to undergo psychological and psychiatric examination, which is why experts could not judge possible disorders. Experts do see a ‘worrying pattern towards women with a certain systematic character.’ Because the Public Prosecution Service wants the man to be treated, also to prevent recurrence, in addition to the prison sentence, TBS with compulsory treatment is also demanded.
According to the man’s lawyer, her client has not been diagnosed with any disorders and therefore TBS should not be imposed. She asked for an acquittal for the rapes and fornication. According to her, her client could not have known that there were children in the chat. For example, the digital platform within which this happened had imposed an age limit. According to her, there are indications of the alternative scenario of the failed robbery in the rape in Groningen. With regard to the rape in Assen, according to the lawyer, camera images show that there was no coercion.
The court will make its ruling on December 17.
