This means he has served 85 percent of his 50-month prison sentence. He can also earn time credits annually for “good behavior” as part of the “First Step Act.”

As The Hollywood Reporter reports, the total length of incarceration also includes the year that Combs spent in custody before the court ruling. Since his arrest in September 2024, he has been in custody in Brooklyn, New York.
Defense appeals
Combs has appealed his conviction and sentence. The motion was filed on October 20, 2025 by his attorney Alexandra Shapiro in federal court in New York. The judge imposed a sentence that was four times higher than what the defense had demanded. “The jury made it very clear in its verdict that it acquitted him of charges of sex trafficking and organized crime,” the lawyers said in a statement. “Not guilty means not guilty.”
The rapper was found guilty of two prostitution-related charges on October 3 following an eight-week trial in July 2025. However, the jury acquitted him of the allegations of sex trafficking and organized crime.
Diddy remains in prison in New York
After his conviction, Combs requested a transfer to the prison in Fort Dix, New Jersey, to be closer to his family and to participate in the drug rehabilitation program there. However, the judge responsible rejected the application.
“The court will recommend a facility in the geographic location chosen by the defense, but not the specific facility identified by the Bureau of Prisons,” federal Judge Arun Subramanian wrote in an Oct. 8 decision. He added that Combs will be placed in a facility in the New York area and may be considered for a rehabilitation program there.
