A 40-year-old man from Meppel was on trial today for assault and rape in his hometown. He was sentenced for this in September 2023 to a prison sentence of thirty months, of which ten months are conditional. The man violated the conditions attached to his sentence.
That is why he would still have to turn off the ten conditional months, but the court in Groningen does not consider that desirable. The court has decided that he does not have to be the conditional part of his prison sentence.
The man was only convicted in September 2023 for an assault in 2004 and a rape in 2005. The case was resolved after a long time, because he gave DNA DNA in early 2022 due to a fireworks offense. This corresponded to the DNA in a sperm trail that was found on the rainwear of one of the victims in the case.
The victim was stuck in 2005 by a man on a scooter when she cycled through a tunnel. The man forced her to sexual acts and then drove away. After investigation, the police could secure sperm tracks.
For example, the police were related to other matters, which had similarities with this rape. As with a report from 2004, where a girl was assaulted at the tunnel. In addition, the man was also prosecuted for an assault of his neighboring neighbor. The woman reported. According to the court, however, there was insufficient other evidence to condemn the man for this case.
The conditions linked to his sentence, among other things, that he was not allowed to use drugs and be treated clinically. The man has violated these conditions. Twice he would have gone wrong with drugs and his treatment was not brought to a successful conclusion. The man should therefore serve the conditional part of his prison sentence.
According to the man, he was in a bad period and he dealt with the wrong people. According to him, the help he received in a clinic was “worthless”. According to the man, it was not true what was mentioned in the reports about him and he did not achieve anything there. He now gets help outside of an institution, which he likes better. He now also has a job. A prison sentence would ensure that he cannot find a home and lose his job. “Then I’ll be outside again with nothing.”
The probation service did not find it desirable that the man would have to go back to the cell. “He is now stable and motivated.”
The public prosecutor also acknowledged that the man is now going through a positive development. “In addition, violating the conditions may also have consequences. It is a split.” Because the OM also concludes that the man is now stable and has not committed new offenses, he does not have to go back to prison. According to the OM, he must finish the treatment he follows and stay away from the drugs.
The court eventually joined that judgment.
