A resident from Steenbergen is right from the judge in the court case about the horse’s shelter of his back neighbors. According to the rules, the guesthouse may not be at that location. The College of Noordenveld, against which the case was brought, must now look at it again.
The judge thus announces the decision of the municipality where the horse’s pension was permitted. It is now up to the college to determine what is happening with the horse boarding. The judge does not make a decision about this, Noordenveld can still appeal.
With the verdict, a years of process may end. In 2021 the Steenberger asked the municipality to maintain the rules. The wholesaler existing at the time was not allowed to go further from the municipality, but a horse pension was. Since then there have been several procedures in which Noordenveld has sustained that the guest house should be allowed.
That ended in the court case last month. In any case, the Steenberger is happy that this lawsuit is now over. But if everything will be resolved, according to him, the question is: “First see, then believe.”
It is certain that the future of the horse pension is in the hands of the municipality. The decision must be taken into account that the guesthouse should not be there according to the rules. This statement can therefore mean the end of the horse boarding. It could also be that hobby horses can only be kept.
The place is designated as business land. But what kind of company may come specifically is not entirely clear. The rules state that companies that are permissible in addition to homes in terms of odor, dust, noise and danger.
According to the court, the Commission must take a new decision within six weeks.
