A US federal court has decided that a lawsuit against Musk may be pursued on Trump for his role in the government agency.

14 states throw Tesla boss Elon Musk before his power powers in the context of his role in the controversial government authority “Department of Government Efficiency”, or Doge, under US President Donald Trump and violated the constitution. Against this background, a US federal judge has now decided that a lawsuit against Musk, which was classified as the “special employee of the government”, may be continued, as Investing.com reports. The submitted lawsuit is directed against Musk’s alleged function as the factual main person responsible for the government agency established by Trump by decree – despite a lack of legal basis.
Unconstitutional power
According to the lawsuit, Doge was founded without the consent of the congress and is said to have received far -reaching powers of budgetary funds, personnel decisions and regulations. According to the plaintiffs, Musk changed entire structures of the authorities in an unconstitutional manner, lifted contracts and received access to sensitive systems. In particular, this violates the St. Constitution’s appointment clause, which prescribes clear rules for the appointment of government officials.
“The constitution does not allow the executive to take over the entire authorization by creating a federal authority unilaterally by executive order and isolated their leading civil servants as mere ‘consultants’ from the constitution,” quotes Democracy Docket, the responsible judge S. Chutkan.
Judicial examination necessary
In a 42-page statement, Chutkan rejected the defense application to dismiss the lawsuit. The plaintiff’s argument that Doge was neither constitutionally nor legally legitimized and Musk’s actions exceeded the legal limits is permitted and require a judicial review.
The lawsuit against Donald Trump in his official function, on the other hand, was rejected. The judge referred to precedents that rule out judicial interventions in the president’s executive discretion decisions.
Musk has now turned her back on the White House in order to be able to concentrate more on Tesla & Co. again, but this was irrelevant in the case, the judge said. Because the Tesla boss had achieved sufficient “private and protected information” in order to be able to do “damage”, which is why the case is being pursued.
