How far can you go on a SM date and when do you cross a line? That question was discussed today at the court in Haarlem, where 27-year-old Jacintha M. from Zeeland was on trial for rape and assault of a sex worker. Justice believes that the suspect has clearly gone too far and demands a year and a half in prison.

Even before Jacintha M. had checked her boyfriend Erno B. and the victim in a hotel near Schiphol in October 2016, things went wrong. The victim had to hand in her phone. “I didn’t feel good about it,” says Jane, who wishes to remain anonymous and therefore prefers to use a fictitious name. “In the end it was Jacintha who tried to reassure me, was kind to me and finally persuaded me to come along.”

Once in the hotel room, things went horribly wrong. Upon entering, the former sex worker already received a slap in the face. After that, butts were also pressed on her breasts, she was beaten with tent poles and she was raped anally with a shower hose. “I was in horrific pain and that night I was very afraid of losing my life,” Jane told NH Nieuws.

    Crucial role

53-year-old Erno B. from Alkmaar was already convicted for raping and assaulting three women. He was sentenced to 5.5 years in prison and has appealed that verdict. So now his girlfriend Jacintha is on trial, who according to justice is also guilty. “The suspect played a crucial role,” said the public prosecutor. “She knew the victim was concerned but brought her in anyway, disregarding her limits.”

The sex date ended after Jane was knocked out by a drug cocktail and all the beatings and woke up in the hotel room bathtub. The two ran off, leaving half of the agreed amount behind. “We had booked her for four hours, but because she went so wrong on the drugs, B. paid half,” said the suspect.

Jane often thinks back to the traumatic evening that turned her life completely upside down. “Of course I also wondered why I didn’t lock the bathroom door. I also considered jumping off the balcony, but because I was secretly drugged, I couldn’t stand on my feet anymore.”

In an emotional victim statement, Jane said she still feels the effects of that one night. “Thanks to the love of my family and friends I have picked up my life a bit again, but there have been many moments when I no longer saw life.”

    Partners in crime

According to Jane, the suspect therefore plays a double role. “I always thought she was a victim of Erno B. herself, but she was just his accomplice. They were partners in crime. She could have prevented me from ending up in this nightmare, from which I could not escape.”

The suspect said that she is shocked by the report and wanted to emphasize to the judges that she finds it very annoying that the victim experienced the evening completely differently. According to her, no boundaries have been crossed. “She just complimented us all night and asked for more blows.”

The defendant’s lawyer therefore also pleads for acquittal. According to him, BDSM (bondage, discipline, dominance and submission and sadism and masochism ed.) involves injury. “Based on the injury, you can’t say it went all wrong.” The court will rule on October 4.
